Dreamstoves.com Victimizes a Cancer Patient

WARNING: If you are thinking of purchasing your dream stove from dreamstoves.com, please consider my unfortunate experience with the company. The short version of the story is that I contracted with dreamstoves.com to buy a very expensive, $7,000 stove and made a $3,500 down payment. Dream Stoves President Christian Maupin promised me the stove would arrive here in time for canning, but it wasn't ready and I missed the season for green beans. Then I was diagnosed with a tumor that required major surgery to remove. (It turned out to be pancreatic cancer.) In light of my medical situation, Mr. Maupin agreed to sell the stove for us in order to refund our down payment. Instead he claimed, without proof, that he sold the stove at a discount, and he kept all of our money.






















The longer version: As you can see from the invoice, dreamstoves.com was required to make delivery in April, but we were still waiting on our stove in May. That's when the unthinkable happened: at 38 years old I was diagnosed with a potentially terminal medical condition. I have a 5-year-old and a 10-year-old who is autistic; I was utterly heartbroken.
We had to make plans and needed all of our resources. Christian Maupin said he would help us but instead he took $3,500 from us.

To date, the only solution he has offered is for us to send him $3,500 more for a lesser stove.

Update: Mr. Maupin refunded $2,000 of our deposit, meaning we are still out $1,500. He would not grant us this partial refund unless we signed a legal document saying we were satisfied with the amount and therefore would not seek to recover the rest of our money.

Ashli, Sure. Here is a detailed list for a restored stove. Also included, is a list of what we do with a refurbished stove. This stove has all the integrity of the other restored stoves you have viewed, but not quite as much pristine chrome detail. I acquired this stove from the original home and it was hardly ever used. Most of the chrome luster is still intact and the porcelain is in very good shape. Here is a checklist of the work that will be completed - 1 - Burner-Cook-Top valves serviced. 2 - Thermostats calibrated and serviced. 3 - Safeties refurbished and tested (guaranteed). 4 - Minor cosmetic repairs and detailing (porcelain, neutralize rust areas, etc.). 5 - Major professional cleaning (grease removed, burners, handles, knobs cleaned). 6 - All gas, mechanical, and electrical systems tested and guaranteed. 7 - Insulation replaced. 8- Burner Grates re-porcelain. 9- One-year warranty included. As you can see that basically the same steps are taken to get these stoves back to correct, and functional working order. The exception being the cost of many of the original chrome and porcelain surfaces re-done on a refurbished stove. The end result is, a reliable stove either way, with the main noticeable cosmetic differences being the very shinny eye-catching chrome. Prices are as follows: $ 4,500.00 nicely refurbished. For comparable purposes a fully restored model would be $ 6,500.00

I thought about getting the cheaper 850, because I was trying to save money, but it wasn't my favorite stove, and if we were going to spend thousands on a stove it might as well be the one we really wanted. So I called Christian Maupin and told him I'd rather get the 6-burner double oven listed on his site. He told me he was selling it to help a restaurant owner recoup the money. The restaurant owner had purchased the stove from dreamstoves.com, found out it didn't meet code, and couldn't have it in his restaurant. I asked Mr. Maupin if the guy would come off the price by $900, because it was around $8,000 plus shipping and more than we wanted to spend on a stove. Mr. Maupin said he asked the guy, but the guy wouldn't budge. HOWEVER, Mr. Maupin told me he would sell me a 6-burner O'Keefe and Merritt for the price I was asking, and he sent me pictures in the following email:

And then the shock of a lifetime: on my daughter's 5th birthday I found out I had a pancreatic tumor. Many people diagnosed with pancreatic cancer die within 3 months of diagnosis. Since I homeschool my children and we live far away from my husband's work, I knew that if I died they would have funeral expenses in addition to the expense of a big move to another city. The decadence of a VERY EXPENSIVE stove was an ill-fit for the horrific, unforeseen bombshell that had just been dropped on all our lives, and I wrote Christian to see if he would refund our money in light of the bewildering circumstances:

Christian, I'm 38 years old with a 5-year-old and a 10-year-old with autism, and I have just been diagnosed with a pancreatic tumor. I'm undergoing lots of testing as you can imagine. The biopsy is next Thursday via endoscopic ultrasound/needle aspiration.

If I'm going to die, my family will have to move out of this house to be closer to family and a better school zone (I homeschool my kids, and they'll have to go to school for the first time). They certainly won't need the oven or the burden of trying to resell it. Instead, they could really use the $7k to pay for my funeral. That would be one burden off their shoulders.

When I ordered the stove we were at a fun, confident place in life. Now my survival and my family's future is in question. If I'm not going to live I don't want to burden my family with a $7k kitchen showpiece for a dead woman.

Help me figure this out, Christian. I'd like to back out with a refund and then come back at a later date if it looks like I'm going to live, but I don't know how you feel about this. I know you don't usually give refunds, but I have a pancreatic tumor, and I'm really worried about my family at this point. Do I have any options?

I am truly sorry about your situation. My sympathies are with you. I hope the best for your situation, and hopefully everything will turn out ok. Unfortunately we are at the very end of the project, and 100% of the cost are spent into it. Unfortunately the economy has dictated my ability to have flexibility with regards to any possible surpluses, like refunds. If we hadn't reach to this point already I could have easily refunded your deposit. The stove is 90% assembled and we have all but just two parts to place on the stove for completion. The only thing I can do is put the stove up for sale and seek a new buyer in order to offer you a refund. However because of the slow economic situation with our troubled times, it might resale sooner or later, but I can't guarantee it. So I will see what I can do to met your request after we finish the project next week.

At that very moment, because of the medical situation, we couldn't afford to spend the rest of our savings on a stove, because it was prior to surgery and thus the pathology report. If it was adenocarcinoma, I knew we would need our savings for my funeral, which would cost approximately $11,000 (I know, because I made my funeral arrangements when I was told the tumor looked malignant and needed to come out). We would have fulfilled our part of the contract no matter what, but it never hurts to ask. So I called Christian Maupin and left a message asking him another favor: to sell the stove for us, if he could, without requiring us to pay the remaining balance first. Since we had already given him $3,500, we believed he would not be taking any sort of loss on the stove while he was trying to sell it for our refund and his profit. He never responded to the phone message, and we never got a bill for the remaining balance, so we assumed Christian Maupin was a swell guy who was being flexible due to our terrible situation. I wrote him to make sure he got the phone message:

How are you doing? I have been moving stuff around here over the last two months, but we did manage to short sale the stove. Unfortunately I sold the stove for the balance owing. So the sale was really just to cover the balance. We also included shipping charges on the resale. Christian, we are absolutely devastated, shocked and mystified as to why you would choose to short sale the stove without letting us know that we would lose ALL of our money--over $3,000. All you had to do was contact us and let us know that you needed payment right away or else we would lose everything. There was never any mention of a short sale and losing our money--only that selling it might take a while. The plan was to sell the stove in order to refund the down payment. I have the emails. We trusted you. Why didn't you contact us? You have our number. We would much rather have completed the sale than lose thousands of dollars. How could you allow that to happen without at least warning us? We have never done anything to wrong or harm you in any way. We never refused to complete the sale, we only asked if you would be willing to sell the stove for us for a refund, due to a potentially catastrophic medical situation. We've been through so much emotional and physical suffering this summer, and now this. You know, our stove is broken, and now we can't even afford to buy a new one, because evidently we've paid for half of someone else's "Dream Stove." How can this be? What did we ever do to you? Isn't there anything you can do to remedy this horrible situation?

I'm very sorry everything didn't work out as planed. I recently sold the stove last month. So I did wait awhile to see if we could accommodate you with any additional monies. My intentions were to try to sale this piece and return any monies I could, ASAP for both of us. Unfortunately more than 50-60% of the restoration cost is tied up in most all of our projects. As a business we were also under much strain, and I tried to recover the cost. Regarding the last phone message/e-mail; I was told by you, that you were not able to cover the balance and to sell the stove, and if any monies were to be returned it would be appreciated. It was clear to me that you had understood the financial situation and that you might not recover any deposit. I'm very sorry if you had made that not clear enough. At this point I can still offer you another stove and possibly accommodate you, to sell it at our core cost for you. Again I'm sorry that everything didn't work out as planned.

As a pancreatic cancer patient I am supposed to avoid stress. Surely you understand this and will work to resolve this situation today.

Ideally, you would offer us the same fully remanufactured stove (that we contracted and paid you $3,500 for) for the remainder of what we owed.

I'm delivering out of town for the week. So please be patient as I'll get back to you ASAP. The short answer to your question is - I'm not offering a $ 3,500.00 credit. Depending on the stove you are wanting again, and also what models we have in stock depends on the cost price of the stove. Currently we don't have another O&M 900 series in our inventory. So if you want that same one, we will need to locate it and go from there. The cost price depends on the price paid for the stove, and restoration labor, materials and such. Typically our cost is between 50-60% of the retail price.

Currently we have an 850, this model is identical,but without windows and 4 burners/griddle. The price would be the same $ 7,000.00. So your price of $ 3,500.00 would apply if it's going to be restored in white. If you are wanting windows, we would have to wait to see what we can get in the future.

The prices that I've quoted depend on each stove with regards to the price we bought them for, as this factor determines the retail price as well. Also remember the 900-G was discounted to you down quite a bit.

That's right, you did discount the 900-G. I gave you $3,500 and got nothing in return due to a terrible misunderstanding after an unforeseen, potentially catastrophic cancer diagnosis. (BTW, how many single-income families just give away $3,500 in the midst of an unfortunate economy and myriad hospital bills? You said you would sell the stove as a favor to us in order to refund our money, which would help us deal with my cancer diagnosis with a bit more financial confidence, but instead you just sold the stove to someone else, and informed us that we would get nothing.)
Now you have my money, I have nothing, and your solution to this awful situation is to offer me the most basic stove for the same amount as the deluxe stove I contracted for. This doesn't seem right to me. But at 38 years old I've been physically and emotionally fighting a raging battle with pancreatic cancer this summer, and trying to be there for my two young children, one of whom is disabled, so perhaps the stress of it all has muddled my thinking.

Therefore what I think I might do is share all of our correspondence in a few different places on the Web just to get some reader feedback so that I can make sure that I am treating you fairly and not having unreasonable expectations of you. I certainly will feel a lot better if my email and blog communities write me (and perhaps you) to confirm that, you are a decent man, and dreamstoves.com is a reliable and trustworthy business who values highly its customers. Who knows? You may even get more business!

On the other hand, if people respond to the situation as we have been instinctively feeling, then we will take that as confirmation that we indeed have a problem here. And of course, we will want to be helpful to our fellow consumers, particularly in this unfortunate economy, via filing complaints against dreamstoves.com with
Ripoff Report, the California Department of Consumer Affairs and the Stockton Chamber of Commerce. The submissions will include our complete correspondence and note your refusal/inability to confirm proof of sale of the stove we contracted for. We will also contact Austin Jowers of antiqueappliances.com, so that he can know of our experience in the event that someone else calls him to inquire about dreamstoves.com, as we did prior to sending you our ill-fated check.

We have set up this web site about our experience with dreamstoves.com. If you believe it contains any inaccuracies, please identify them, and we will make any warranted corrections. We are also preparing a RipOff Report, which, unlike our web site, cannot be modified or removed once posted. We know that your product is esoteric and that Web-based advertising is therefore particularly important, and we are agonizing over this situation, because our aim is not to hurt your business. But you said you would help us during an horrific cancer diagnosis and instead took $3,500 from our family. This is our final appeal to you prior to filing complaints that cannot be undone. You said you would sell the stove FOR US to refund our deposit. You sold the stove. We are awaiting Mr. Maupin's phone call and hopefully a resolution that will satisfy all.

Update: Mr. Maupin refunded $2,000 of our deposit, meaning we are still out $1,500. He would not grant us this partial refund unless we signed a legal document saying we were satisfied with the amount and therefore would not seek to recover the rest of our money.

This is the super deluxe $7,000 stove I contracted and paid a $3,500 deposit for.

This is the more plain stove Christian Maupin offered me at the deluxe price after selling the stove we paid a $3,500 deposit for. (As you can see from the correspondence, he initially offered me this plain stove, fully refurbished, at $500 LESS than he offered it to me after he sold the stove we contracted for and kept our $3,500 deposit.)
